Governing Law: Washington State, USA

1. Service Listings & Work Orders
Service listings represent labor and technical expertise, not tangible goods eligible for standard e-commerce checkout.
All services require a consultation and are documented in a formal work order (WO), which serves as the project quote. A work order must be issued before any items are shipped to the shop.
Customers must have a current mailing address and phone number on file for a work order to be created.
Services are invoiced upon completion of the project. Return shipping costs are calculated and added to the final invoice.
International service requests are generally declined due to the cost and complexity of international shipping, tariffs, and duties. Acceptance of international service work, if any, is evaluated on a case-by-case basis and remains at the discretion of TKS CUSTOM SUPER MODZ LLC.
2. Shipping Intake & Tracking
Customers must provide tracking information for all inbound shipments.
The assigned work order number must be clearly marked on the exterior of all packages.
Items shipped without a work order, without tracking, or without proper identification may be rejected or held as unidentified property.
Shipments sent to the publicly listed address without authorization may be refused.
3. Parts Reservations
Parts supplied by TKS CUSTOM SUPER MODZ LLC are reserved specifically for an individual work order.
Parts reservations become effective once inbound tracking information is provided.
If a work order is terminated before service begins, the parts reservation is dissolved and parts are returned to inventory.
If services are removed and parts are retained, the order may be converted to a parts-only order and invoiced accordingly.
4. Processing Time
Processing times are determined by current workload and are communicated during consultation.
Typical turnaround times range from one (1) to eight (8) weeks and are estimates only.
Work orders are processed in the order received. Earlier arrival results in higher queue priority.
Once service work has begun, the work order may not be terminated. Scope changes may still occur with approval and applicable cost adjustments.
5. Queue Management & Additional Costs
Unforeseen issues may require scope changes or cost adjustments.
Customers will be contacted for approval when required. Failure to respond within twenty-four (24) hours may place the work order on hold.
Minor cost adjustments of five dollars ($5.00) or less may be automatically approved to maintain workflow, up to a maximum of twenty dollars ($20.00), unless otherwise agreed during consultation.
6. Packaging & Shipping Responsibilities
Customers are responsible for proper packaging and inbound shipping costs.
Items must be shipped in sturdy boxes with adequate internal padding. Flimsy retail boxes are discouraged.
If inadequate packaging is received, replacement materials may be used for return shipment and the cost added to the final invoice.
7. Proper Electronics Handling
Exposed electronic components must be protected against electrostatic discharge (ESD).
If adequate ESD protection is not provided, required materials may be added to the return invoice.
Fully assembled consoles generally provide sufficient internal ESD protection.
8. Storage Media Handling & Testing
Storage media are not required for most services and should not be sent unless necessary.
If storage media are included, TKS CUSTOM SUPER MODZ LLC may power and use the media for testing purposes only.
TKS CUSTOM SUPER MODZ LLC does not access, load, alter, overwrite, or delete a customer’s existing game saves, profiles, progress, or personal data unless expressly directed by the customer.
Testing activities may result in the creation of incidental test data. Such data may or may not be removed after testing and does not create any obligation to return the storage device in its prior data state.
Customers are solely responsible for backing up all data prior to shipment.
TKS CUSTOM SUPER MODZ LLC assumes no responsibility for data loss under any circumstance.
9. Unclaimed Property, Unpaid Invoices, & Storage Fees
By submitting your device for repair/service, specifically an Original Xbox or Xbox 360 console (including any included controllers, accessories, or parts), you acknowledge and agree to the following terms regarding unpaid or unclaimed property. These terms are enforced in accordance with applicable Washington State law, including the Revised Code of Washington (RCW) 60.08 (Chattel Liens) and 63.24 (Unclaimed Property in Hands of Bailee).
9.1. Right of Possession (Lien Claim)
You understand and agree that we have a possessory lien on your specific console and any associated accessories or parts for the agreed-upon price of labor, skill, materials furnished for the repair, and any accrued storage fees. We retain the right to keep possession of the item until full payment is received.
9.2. Storage Fees for Unclaimed Items
-
- Grace Period: There is an initial grace period of thirty (30) days after we notify you via email/phone that your console repair is complete and ready for pickup or shipment.
- Accrual of Fees: If the item is not picked up/shipped out and the final invoice remains unpaid after this initial 30-day grace period (or agreed-upon extension), a storage fee of Ten Dollars ($10.00) per day will be billed to your invoice, starting on Day 31 (or the day after the extension ends).
- Extensions & Forgiveness: The initial grace period may be extended, or accrued storage fees may be partially or wholly forgiven, at our sole discretion, if you proactively communicate payment difficulties or provide a reasonable plan for payment and pickup/shipment. All extensions and forgiveness agreements must be confirmed by us in writing (email accepted, provided it originates from our official business email address: TKsCustomSuperModz@gmail.com).
- Reasonableness: You acknowledge that this fee is a reasonable estimate of the daily costs associated with secure storage, handling, insurance, and administrative overhead.
-
Lien Inclusion: These accumulated storage fees are added to the total amount you owe and are secured by our possessory lien on your property.
9.3. Timeline for Disposal of Property
If the invoice, including all accrued storage fees, remains unpaid for ninety (90) days after the date the repair is completed and the final invoice is sent, TKS CUSTOM SUPER MODZ LLC is authorized to deem the property as unclaimed or abandoned, and we are authorized to begin the formal disposal process.
9.4. Notice of Intent to Sell/Dispose
If payment is not received after the 90-day period, TKS CUSTOM SUPER MODZ LLC is authorized to initiate the formal lien foreclosure process as required by Washington State law. We are authorized to send a formal Notice of Intent to Sell/Dispose via certified mail to the last known mailing address you provide on this work order. This notice will be sent in compliance with RCW 63.24.150. The notice will state:
-
- The original invoice amount plus the total amount of accrued charges owed.
- A description of the property (e.g., "Black Original Xbox console, Serial #12345, 1 controller, 1 power supply").
- A final deadline (at least 30 days from the mailing date) by which all charges must be paid to reclaim the item.
- That failure to pay by the deadline will result in the public sale or disposal of the property.
9.5. Public Sale and Disposition of Proceeds
If payment is not received by the date specified in the notice, TKS CUSTOM SUPER MODZ LLC is authorized to sell the Original Xbox/Xbox 360 console (including any included controllers, accessories, or parts) at a public auction/sale following publication requirements in local newspapers (as dictated by RCW 60.08) or dispose of it per RCW 63.24.160 if the reasonable aggregate value is less than one hundred dollars.
Proceeds from the sale will be first used to cover the costs of the sale, the legal process, the outstanding repair invoice, and all accrued storage fees. Any surplus funds that may remain after all debts are satisfied will be held for the original owner and, if unclaimed after a certain period, remitted to the Washington State Department of Revenue as unclaimed property.
If the proceeds from a public sale are insufficient to cover the total amount owed, TKS CUSTOM SUPER MODZ LLC reserves the right to pursue a deficiency judgment against you for the remaining balance in small claims court. Legal action can be avoided if you provide a formal, written "Surrender of Property Letter" sent from your email address on file to our official business email address (TKsCustomSuperModz@gmail.com). This letter must include the work order number, explicitly release your claim to the property, and acknowledge that TKS CUSTOM SUPER MODZ LLC is authorized to dispose of it in a commercially reasonable manner, which will close the debt file and halt any pending legal action for the balance owed.
9.6. Limitation of Liability
By submitting a tracking number and shipping your Original Xbox or Xbox 360 console (including any included controllers, accessories, or parts) to the registered business address of TKS CUSTOM SUPER MODZ LLC, you acknowledge that failure to pay and reclaim your property within the specified timeframe releases us from liability for disposing of the property when such disposal is performed in good faith and in strict compliance with applicable Washington State law. A bailee is not liable to the owner for unclaimed property disposed of in good faith in accordance with the requirements of this chapter.
